faly.app web sitesindeki ("Landing") çerezlere ilişkin rıza, bu formda yer alan uygulama kapsamlarından ayrı ve bağımsız olarak, sitenin çerez onay bannerı aracılığıyla yönetilmektedir. Genel Bilgilendirme

Kapsam 3 (reklamcılık ve reklam takibi) isteğe bağlıdır; bu kapsamı vermemeniz veya geri almanız hâlinde temel hizmet akışı etkilenmez.

Kapsam 1'deki özel nitelikli veriler isteğe bağlıdır: Kapsam 1'de listelenen özel nitelikli veri kategorileri yalnızca siz bu bilgileri sohbet içeriğinizde gönüllü olarak paylaşırsanız işlenir. Cinsel yönelim, dini inanç veya diğer hassas konularda bilgi paylaşmak hiçbir şekilde zorunlu değildir. Bu tür bilgileri paylaşıp paylaşmamanızdan bağımsız olarak hizmetten yararlanabilirsiniz.

Kapsam 1 — Özel Nitelikli Kişisel Veri İşleme

Truemium OÜ tarafından işletilen faly uygulamasının, fal yorumu ve sohbet hizmeti kapsamında aşağıdaki özel nitelikli kişisel verilerimi işlemesine açıkça rıza gösteriyorum:

Ruhsal durum ve inanç bilgisi: Sohbet içeriğimde paylaştığım ya da uygulamaya ilettiğim sorulardan çıkarımla elde edilen ruhsal, mistik veya dinî inanç bilgileri.
Dini inanç bilgisi: Sohbet içeriğimde yer alan ya da fal yorumu bağlamında çıkarım yoluyla ortaya çıkan dinî inanç veya ibadet alışkanlıklarına ilişkin veriler.
Cinsel yönelim, cinsel hayat ve ilişki durumu bilgisi (İSTEĞE BAĞLI — yalnızca gönüllü olarak paylaşılması hâlinde): Sohbet içeriğimde gönüllü olarak paylaştığım ilişki durumu, medeni durum, cinsel yaşam veya cinsel yönelime ilişkin çıkarım içerebilecek veriler. Bu bilgileri paylaşmak zorunda değilim; söz konusu bilgileri paylaşmadan da hizmetten yararlanabilirim.
Meslek bilgisi: Sohbet içeriğimde açıkladığım veya sorularımda ima edilen mesleki bilgiler.

İşleme amacı: Yukarıdaki özel nitelikli veriler; bana özel fal yorumu üretmek ve sohbet sorularıma yanıt vermek amacıyla yapay zeka modeli tarafından işlenmektedir. Bu veriler yalnızca bu kapsama dayalı açık rızanızla işlenmektedir; başka hiçbir hukuki dayanağa (meşru menfaat dahil) başvurulmamaktadır.

Hukuki dayanak: KVKK Madde 6 kapsamında açık rıza / GDPR Madde 9(2)(a).

Yapay zeka sağlayıcısı: Sohbet içeriği ve fal sorularınız; yanıt üretmek amacıyla OpenAI'ya iletilmektedir. OpenAI bu verileri model eğitiminde kullanmamaktadır. OpenAI ile imzalanan veri işleme sözleşmesi bu güvenceyi bağlayıcı biçimde düzenlemektedir.

Yeterli önlemler: Özel nitelikli verileriniz yalnızca şifreli kanallar üzerinden iletilmekte; işleme yalnızca fal hizmeti kapsamıyla sınırlı kalmakta; veriye erişim ihtiyaç-bazlı yetkilendirme ilkesiyle kısıtlanmakta ve yapay zeka sağlayıcısıyla imzalanan sözleşme söz konusu verilerin model eğitiminde veya üçüncü taraflarla paylaşımında kullanılmamasını güvence altına almaktadır.

Bu rızayı vermemeniz hâlinde: Sohbet içeriği ve fal sorularınız yapay zeka tarafından işlenemez; dolayısıyla uygulamanın sohbet ve fal yorumu işlevi kullanılamaz hâle gelir. Yapay zeka çıkarım sağlayıcısı — OpenAI: Fal yorumu üretmek ve sohbet yanıtları oluşturmak amacıyla sohbet içeriğim ve fal sorularım OpenAI'ya iletilmektedir. Yapay zeka sohbeti içinde eklediğim görseller OpenAI'ya iletilmekte ve Faly'nin S3 depolama alanında saklanmaktadır; cihazda işleme beyanı yalnızca şablon/kahve fincanı okuma fotoğrafı için geçerlidir. OpenAI bu verileri model eğitiminde kullanmamaktadır. AB/AEA dışında gerçekleşen aktarımlar için güvence mekanizması: AB kullanıcıları için AB-ABD Veri Gizliliği Çerçevesi (EU-US DPF) ve Standart Sözleşme Maddeleri (SCCs); Türkiye kullanıcıları için KVKK kapsamındaki aktarım mekanizması.
Bulut ve reklam hizmet sağlayıcıları: Bulut/altyapı işlemcileri AEA merkezlidir (Faly S3). Reklam işlemcisi AppLovin'dir (Amerika Birleşik Devletleri); reklam tanımlayıcınız AppLovin'e Standart Sözleşme Maddeleri kapsamında aktarılmakta olup bu durum CCPA/CPRA kapsamında "satış/paylaşım" niteliği taşıyabilir (bkz. Kapsam 3 ve Gizlilik Bildirimi §10).

Bu rızayı vermemeniz hâlinde: Yapay zeka çıkarımına dayanan fal yorumu ve sohbet hizmetleri sunulamaz; bu nedenle uygulamanın temel işlevi kullanılamaz hâle gelir.

General Information

This form contains three separate consent scopes. Each scope is independent: granting or declining any one scope does not affect the others. Scope 1 (special-category data processing) and Scope 2 (cross-border data transfer) are required for the AI-powered chat and fortune-reading service; declining or withdrawing either of these scopes will make that service unavailable. Photo capture and on-device features remain available without them. Scope 3 (advertising and ad tracking) is optional; declining or withdrawing it does not affect the core service flow.

Special-category data in Scope 1 is optional: the special-category fields listed in Scope 1 are collected only if you voluntarily share that information in your chat content. You are never required to provide information about sexual orientation, religious beliefs, or other sensitive topics. The service is available regardless of whether you choose to share such information.

Every scope is off by default (unticked). To grant consent, you must deliberately and separately tick the corresponding box.

Scope 1 — Special-Category Personal Data Processing

I explicitly consent to Truemium OÜ, operating the faly application, processing the following special-category personal data in connection with the fortune-reading and chat service:

Spiritual state and belief information: Spiritual, mystical, or religious belief information expressed through my chat content or inferred from the questions I submit to the application.
Religious belief information: Data relating to religious beliefs or worship practices contained in my chat content, or inferred in the context of a fortune reading.
Sexual orientation, sexual life and relationship status information (OPTIONAL — only if voluntarily provided): Data relating to relationship status, marital status, sexual life, sexual orientation, or inferences that may arise from content I voluntarily share in chat. I am under no obligation to share this information and may use the service without providing it.
Professional information: Occupational information I disclose or imply in my chat content or questions.

Purpose of processing: The special-category data above is processed by an AI model solely for the purpose of generating a personalised fortune reading and responding to my chat questions. This data is processed exclusively on the basis of this explicit consent; no other legal basis (including legitimate interest) is invoked.

Legal basis: Explicit consent under KVKK Article 6 / GDPR Article 9(2)(a).

AI provider: My chat content and fortune questions are transmitted to OpenAI for the purpose of generating responses. OpenAI does not use this data for model training. The data processing agreement concluded with OpenAI gives binding effect to this commitment.

Adequate safeguards: Your special-category data is transmitted only over encrypted channels; processing is strictly limited to the fortune-reading service context; access to the data is controlled on a need-to-know basis; and the data processing agreement with the AI provider ensures that this data is not used for model training or shared with third parties.

If you do not grant this consent: Chat content and fortune questions cannot be processed by the AI, which means the application's chat and fortune-reading functionality will not be available. You are never required to share special-category information (such as sexual orientation or religious beliefs) to use the service; this consent covers any such data you choose to include voluntarily in your chat.

Scope 2 — Cross-Border Data Transfer

Recipient categories and transfer purposes:

AI inference provider — OpenAI: My chat content and fortune questions are transferred to OpenAI for the purpose of generating fortune readings and chat responses. Images I attach within the AI chat are transmitted to OpenAI and stored in faly's S3; the on-device statement applies to the template/cup-reading photo only. OpenAI does not use this data for model training. For transfers taking place outside the EEA, the applicable safeguard mechanisms are: EU-US Data Privacy Framework (EU-US DPF) and Standard Contractual Clauses (SCCs) for EU users; the KVKK transfer mechanism for Turkey users.
Cloud and advertising processors: Cloud/infrastructure processors are EEA-based (faly's S3). The advertising processor is AppLovin (United States); your advertising identifier is transferred to AppLovin under Standard Contractual Clauses and this may constitute a 'sale/share' under CCPA/CPRA (see Scope 3 and Privacy Notice §10).

If you do not grant this consent: Fortune-reading and chat services that rely on AI inference cannot be provided, which means the application's core functionality will not be available.

This consent may be withdrawn at any time by emailing info@faly.app or by sending a written application to the registered address. Withdrawal does not affect the lawfulness of transfers carried out before withdrawal.

Scope 3 — Advertising and Ad Tracking

I explicitly consent to Truemium OÜ and its advertising partner AppLovin processing my personal data and advertising identifiers (including the iOS IDFA) for the following purposes:

Personalised ad delivery
Ad performance measurement and attribution analysis
In-app and cross-app behavioural tracking via the device advertising identifier (IDFA)

iOS App Tracking Transparency (ATT) linkage: Consent granted for this scope is linked to the permission request under the iOS App Tracking Transparency framework. Granting this scope requires that the system ATT permission has also been granted; both are recorded as a combined action. Revoking the ATT permission in iOS system settings is treated as withdrawal of consent for this scope.

If you do not grant this consent: Non-personalised ads may be shown; however, IDFA-based tracking and personalisation will not take place. The core service flow (chat and receiving a reading) is independent of this scope and is not affected.

This consent may be withdrawn at any time by emailing info@faly.app or through the privacy preferences in the iOS Settings application.

Withdrawal of Consent and Your Rights

You may withdraw consent for any individual scope (Scopes 1, 2, or 3) at any time by emailing info@faly.app, or by sending a written application to Paavli tn 5a/1, 10412 Tallinn, Estonia or to KVKK Turkey Representative Burak Özdemir, without affecting the other scopes. Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal.
