1. Taraflar ve Lisanslı Uygulama
Bu Son Kullanıcı Lisans Sözleşmesi ("EULA"), siz ("Son Kullanıcı") ile aşağıda tanımlanan şirket arasında bir hukuki sözleşmedir:

"Lisanslı Uygulama"; Faly mobil uygulamasını (iOS ve Android) ve tüm güncelleme, iyileştirme veya yeni özellikleri kapsar.
Bu EULA, Lisanslı Uygulamayı kullanma lisansınızı düzenler. Ödeme ve satın alma koşulları Faly Kullanım Koşulları'nda ve Altın Kredi Koşulları'nda ayrıca belirtilmiştir. Gizlilik koşulları yalnızca Faly Gizlilik Bildirimi'nde yer almakta olup bu EULA ayrı bir gizlilik hükmü içermemektedir.
2. Lisans Hakkının Verilmesi
Bu EULA ve Faly Kullanım Koşulları'na uymanız koşuluyla Truemium OÜ, Lisanslı Uygulamayı size ait veya kontrolünüzde bulunan bir mobil cihaza indirmeniz, yüklemeniz ve kişisel, ticari olmayan amaçlarla kullanmanız için sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans vermektedir.
3. Lisans Kapsamı
Aşağıdakileri yapmak yasaktır:
- Lisanslı Uygulamayı veya herhangi bir bölümünü kopyalamak ya da yeniden dağıtmak.
- Lisanslı Uygulamayı değiştirmek, uyarlamak, çevirmek, tersine mühendislik uygulamak, kaynak kodunu çözmeye çalışmak, parçalarına ayırmak veya türev çalışmalar oluşturmak.
- Lisanslı Uygulamayı veya bu kapsamdaki herhangi bir hakkı kiralamak, ödünç vermek, satmak, alt lisans vermek ya da başka bir şekilde üçüncü taraflara devretmek.
- Lisanslı Uygulama üzerindeki veya içindeki tescilli bildirimleri (telif hakkı ve ticari marka bildirimleri dahil) kaldırmak, gizlemek veya değiştirmek.
- Lisanslı Uygulamayı herhangi bir ticari amaçla ya da kamuya açık biçimde kullanmak.
- Lisanslı Uygulamadaki teknik koruma önlemlerini devre dışı bırakmaya veya aşmaya çalışmak.
4. Kullanıcı İçeriğine Lisans
4.1 Sohbet İçeriği
Faly falcı arayüzüne metin tabanlı sohbet içeriği göndererek Truemium OÜ'ye; söz konusu içeriği yalnızca ve yalnızca fal yorumunu oluşturmak, sunmak ve Faly hizmetini işletmek amacıyla işleme, iletme (OpenAI gibi üçüncü taraf yapay zeka çıkarım sağlayıcılarına iletim dahil), çoğaltma ve kullanma konusunda sınırlı, münhasır olmayan, dünya genelinde geçerli ve telif ücretsiz bir lisans vermektesiniz. Sohbet içeriğinizin mülkiyeti size aittir; bu lisans yalnızca hizmeti sunmamız için verilir. Bu lisans, ilgili içeriği silmenizle veya hesabınızı kapatmanızla sona erer; yürürlükteki mevzuattan kaynaklanan saklama yükümlülükleri saklıdır.
4.2 Kahve Fincanı Fotoğrafları
Kahve fincanı fotoğrafları yalnızca cihazınızda işlenir; Truemium OÜ'ye veya herhangi bir üçüncü tarafa iletilmez. Bu nedenle kahve fincanı fotoğraflarınız üzerinde Truemium OÜ'ye herhangi bir lisans vermemektesiniz. Bu, Faly'nin gizliliği korumak amacıyla benimsediği tasarım tercihidir.
4.3 Yapay Zeka Modeli Eğitimi Yapılmaz
Lisanslı Uygulama aracılığıyla gönderdiğiniz hiçbir içerik, Truemium OÜ tarafından yapay zeka modeli eğitiminde kullanılmaz. OpenAI da API aracılığıyla işlenen içerikleri model eğitimi için kullanmaz.
5. Eğlence Amaçlı Sorumluluk Reddi — Yapay Zeka Üretimi Fal Yorumları
Lisanslı Uygulama tarafından üretilen fal yorumları, otomatik bir yapay zeka sistemi (OpenAI altyapısı) tarafından oluşturulmaktadır ve yalnızca eğlence amaçlıdır. Bu yorumlar; tıbbi, hukuki, finansal, psikolojik veya herhangi bir alanda profesyonel tavsiye niteliği taşımaz ve bu amaçla kullanılamaz. Lisanslı Uygulamayı kullanmanız, sizinle bir falcı veya danışman arasında herhangi bir mesleki ilişki kurulduğu anlamına gelmez.
6. Yaş Şartı
Lisanslı Uygulamayı kullanabilmek için en az 18 yaşında olmanız gerekir. 18 yaşın altındaki kişilerin kullanımı yasaktır. Bu şartın denetimi için uygulama içi bir yaş doğrulama mekanizması uygulanmaktadır.
7. Reklam Destekli Katman ve Altın Krediler
Lisanslı Uygulamanın ücretsiz katmanı reklam desteklidir: kullanım sırasında üçüncü taraf reklamlar gösterilir. Premium özelliklere erişmek için Faly Altını kredisini tek seferlik tüketilebilir uygulama içi satın alım olarak edinebilirsiniz. Altın krediler bir abonelik değildir: otomatik yenileme ve yinelenen ücret yoktur. Ödeme ve satın alma koşulları Faly Kullanım Koşulları'nda ve Altın Kredi Koşulları'nda belirtilmiştir.
8. Gizlilik
Lisanslı Uygulamayı kullanmanız, Uygulama'nın Ayarlar bölümündeki Gizlilik bağlantısında yer alan Faly Gizlilik Bildirimi'ne tabidir. Gizlilik Bildirimi; Truemium OÜ'nün kişisel verilerinizi nasıl topladığını, kullandığını, sakladığını ve koruduğunu açıklamakta, GDPR ve KVKK kapsamındaki haklarınızı anlatmaktadır. Bu EULA gizlilik hükmü içermez; Gizlilik Bildirimi'ni tamamlamaz veya onun yerine geçmez.
9. Üçüncü Taraf Hizmetler
Lisanslı Uygulama, üçüncü taraf hizmetlerden yararlanmaktadır. Bu hizmetlerin kullanımı ilgili tarafların kendi koşullarına tabidir:
- OpenAI: Fal yorumu üretimi için yapay zeka çıkarımı (openai.com/policies).
- Apple App Store / Google Play: Dağıtım ve uygulama içi satın alma platformu (ilgili mağaza koşulları geçerlidir).
- Reklam ağları: Ücretsiz katmanda entegre reklam SDK'ları aracılığıyla reklam gösterimi.
Truemium OÜ, üçüncü taraf hizmet sağlayıcıların koşullarından, gizlilik uygulamalarından veya eylemlerinden sorumlu değildir.
10. Bakım ve Destek
Truemium OÜ, yürürlükteki mevzuatın gerektirdiği ölçüde Lisanslı Uygulamaya ilişkin bakım ve destek hizmetlerini sağlamaktan münhasıran sorumludur. Apple Inc. ("Apple") Lisanslı Uygulama kapsamında bakım ve destek hizmeti sunma konusunda herhangi bir yükümlülük taşımamaktadır.
11. Garanti
YÜRÜRLÜKTEKI MEVZUATIN İZİN VERDİĞİ AZAMI ÖLÇÜDE TRUEMIUM OÜ, LİSANSLI UYGULAMAYI "OLDUĞU GİBİ" VE "MEVCUT HALİYLE" SUNMAKTA OLUP HERHANGİ BİR AÇIK VEYA ZIMNİ GARANTİ VERMEMEKTEDİR. TRUEMIUM OÜ; TİCARİ ELVERİŞLİLİK, BELİRLİ BİR AMACA UYGUNLUK VE İHLAL ETMEME GÜVENCESI DAHİL OLMAK ÜZERE TÜM GARANTİLERİ REDDEDER.
Apple sorumluluk reddi: Lisanslı Uygulamanın geçerli herhangi bir garantiye uymaması durumunda Apple'ı bilgilendirebilir; Apple, Lisanslı Uygulama için ödediğiniz satın alma bedelini size iade eder. Yürürlükteki mevzuatın izin verdiği azami ölçüde Apple, Lisanslı Uygulama ile ilgili başka herhangi bir garanti yükümlülüğü taşımaz; garantiye uyumsuzluktan kaynaklanan diğer tüm talepler, kayıplar, yükümlülükler, zararlar, maliyetler veya giderler Truemium OÜ'nün münhasır sorumluluğundadır.
12. Ürün Sorumluluğu ve Üçüncü Taraf Talepleri
Apple değil, Truemium OÜ; Lisanslı Uygulamaya ya da Lisanslı Uygulamayı bulundurmanıza ve/veya kullanmanıza ilişkin sizin veya herhangi bir üçüncü tarafın taleplerine yanıt vermekten sorumludur. Bu talepler şunları kapsar ancak bunlarla sınırlı değildir:
- Ürün sorumluluğu talepleri.
- Lisanslı Uygulamanın herhangi bir yasal veya düzenleyici zorunluluğa uymadığına dair talepler.
- Tüketici koruma, gizlilik veya benzeri mevzuat kapsamındaki talepler.
13. Fikri Mülkiyet İhlali
Lisanslı Uygulamanın veya Lisanslı Uygulamayı bulundurmanızın ya da kullanmanızın üçüncü bir tarafın fikri mülkiyet haklarını ihlal ettiğine dair bir taleple karşılaşılması durumunda, söz konusu fikri mülkiyet ihlali talebinin soruşturulması, savunulması, çözüme kavuşturulması ve sonlandırılmasından Apple değil, münhasıran Truemium OÜ sorumludur.
14. İhracat Uyumluluğu
Aşağıdaki beyan ve güvenceleri verdiğinizi kabul etmektesiniz:
- ABD Hükümeti'nin ambargosuna tabi bir ülkede ya da ABD Hükümeti tarafından "terörü destekleyen ülke" olarak tanımlanan bir ülkede bulunmadığınızı.
- ABD Hükümeti'nin yasaklı veya kısıtlı kişiler listelerinin hiçbirinde yer almadığınızı.
Lisanslı Uygulamayı kullanımınızla bağlantılı olarak tüm uygulanabilir ihracat mevzuatı ve yönetmeliklerine uymayı kabul etmektesiniz.
15. Apple Üçüncü Taraf Lehdar
Apple Inc. ve Apple'ın iştirakleri bu EULA'nın üçüncü taraf lehtarları olduğunu ve bu EULA'nın koşullarını kabul etmenizle birlikte Apple'ın bu EULA'yı üçüncü taraf lehdar sıfatıyla size karşı uygulama hakkını kazanacağını (ve kabul etmiş sayılacağını) kabul edip onaylıyorsunuz.
Bu Madde 15, Apple App Store aracılığıyla dağıtılan iOS sürümüne uygulanır. Google Play aracılığıyla dağıtılan Android sürümüne uygulanmaz.
16. Sözleşmenin Sona Ermesi
Bu EULA, siz feshettikçe yürürlükte kalır. Bu EULA'nın herhangi bir hükmüne uymamanız durumunda haklarınız Truemium OÜ'den herhangi bir bildirim yapılmaksızın otomatik olarak sona erer. Bu EULA'nın sona ermesi halinde Lisanslı Uygulamayı kullanmayı bırakmanız ve tüm kopyaları cihazlarınızdan silmeniz gerekir.
Truemium OÜ, Faly Kullanım Koşulları'nın ihlali durumunda Lisanslı Uygulamaya erişiminizi dilediği zaman askıya alabilir veya sonlandırabilir. Fesih durumunda kullanılmamış Altın krediler iade edilmeksizin iptal olur; Faly Kullanım Koşulları §7 ve §8'de öngörülen hâller bunun istisnasıdır.
17. Uygulanacak Hukuk
Bu EULA, Estonya hukukuna ve uygulanabildiği ölçüde AB hukukuna tabidir ve bu hukuka göre yorumlanır.
Tüketici koruma güvencesi: Bu EULA'nın hiçbir hükmü, daimi ikamet ettiğiniz ülkenin zorunlu tüketici koruma mevzuatının size sağladığı güvenceyi ortadan kaldırmaz. Türkiye'deki tüketiciler Türk tüketici koruma mevzuatı kapsamındaki tüm haklarını korur ve Türk mahkemelerine ya da tüketici hakem heyetlerine başvurabilir. AB/AEA'daki tüketiciler, uygulanabilir yerel zorunlu tüketici koruma mevzuatı kapsamındaki tüm haklarını korur. Bu EULA'nın hiçbir hükmü, Türkiye veya AB/AEA'daki tüketicilere yabancı münhasır bir yargı yetkisi dayatmaz.

1. Parties and Licensed Application
This End-User Licence Agreement ("EULA") is a legal agreement between you ("End-User") and:

"Licensed Application" means the Faly mobile application (iOS and Android), including any updates, enhancements, or new features.
This EULA governs your licence to use the Licensed Application. Separate subscription and billing terms are set out in the Faly Terms of Service and the Subscription Terms. Privacy terms are set out exclusively in the Faly Privacy Notice; this EULA contains no privacy substance of its own.
2. Licence Grant
Subject to your compliance with this EULA and the Faly Terms of Service, Truemium OÜ grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use one copy of the Licensed Application on a mobile device that you own or control, solely for your personal, non-commercial purposes.
3. Scope of Licence
You may not:
- Copy or redistribute the Licensed Application or any part of it.
- Modify, adapt, translate, reverse-engineer, disassemble, or decompile the Licensed Application or create derivative works based on it.
- Rent, lease, lend, sell, sublicense, or otherwise transfer the Licensed Application or any rights in it to any third party.
- Remove, obscure, or alter any proprietary notices (including copyright and trademark notices) on or within the Licensed Application.
- Use the Licensed Application for any commercial purpose or for any public display (commercial or non-commercial).
- Circumvent or attempt to circumvent any technical protection measures in the Licensed Application.
4. Licence to User-Generated Content
4.1 Chat Content
By submitting text-based chat content to the Faly fortune-teller interface, you grant Truemium OÜ a limited, non-exclusive, worldwide, royalty-free licence to process, transmit (including to third-party AI inference providers such as OpenAI), reproduce, and use that content solely and exclusively for the purpose of generating and delivering your fortune reading and operating the Faly service. You retain ownership of your chat content; this licence is granted solely so we can operate the service. This licence terminates when you delete the relevant content or close your account, subject to any retention obligations under applicable law.
4.2 Coffee-Cup Photographs
Coffee-cup photographs are processed on-device only and are not transmitted to Truemium OÜ or to any third party. Accordingly, you do not grant Truemium OÜ any licence over your coffee-cup photographs. This is a deliberate privacy-protective design choice.
4.3 No AI Training
No content you submit through the Licensed Application is used for AI model training by Truemium OÜ. OpenAI does not use API-submitted content to train its models.
5. Entertainment Disclaimer — AI-Generated Readings
Fortune readings produced by the Licensed Application are generated by an automated artificial intelligence system (powered by OpenAI) and are provided for entertainment purposes only. They do not constitute, and must not be relied upon as, professional medical, legal, financial, psychological, or any other form of professional advice. No fortune-teller–client or advisor–client relationship is formed by your use of the Licensed Application.
6. Age Requirement
You must be at least 18 years of age to use the Licensed Application. Use by persons under 18 is prohibited. An in-app age gate is implemented to help enforce this requirement.
7. Ad-Supported Tier and Gold Credits
The free tier of the Licensed Application is ad-supported: third-party advertisements are displayed during use. You may purchase Faly Gold credits as one-time consumable in-app purchases to access premium features. Gold credits are not a subscription: there is no auto-renewal and no recurring charge. Payment and purchase terms are set out in the Faly Terms of Service and Gold Credits Terms.
8. Privacy
Your use of the Licensed Application is governed by the Faly Privacy Notice, available at the Privacy link in the App's Settings section. The Privacy Notice sets out how Truemium OÜ collects, uses, retains, and protects your personal data, and describes your rights under GDPR and KVKK. This EULA does not contain privacy terms and does not supplement or replace the Privacy Notice.
9. Third-Party Services
The Licensed Application integrates third-party services. Your use of those services is subject to their own terms:
- OpenAI: AI inference for fortune reading generation (openai.com/policies).
- Apple App Store / Google Play: Distribution and in-app purchase platform (see respective store terms).
- Advertising networks: Ad-supported tier served through integrated advertising SDKs.
Truemium OÜ is not responsible for the terms, privacy practices, or actions of third-party service providers.
10. Maintenance and Support
Truemium OÜ is solely responsible for providing maintenance and support for the Licensed Application, to the extent required by applicable law. Apple Inc. ("Apple") has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
11. Warranty
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUEMIUM OÜ PROVIDES THE LICENSED APPLICATION "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TRUEMIUM OÜ DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Apple disclaimer: In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Truemium OÜ's sole responsibility.
12. Product Liability and Third-Party Claims
Truemium OÜ, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:
- Product liability claims.
- Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement.
- Claims arising under consumer protection, privacy, or similar legislation.
13. Intellectual Property Infringement
In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Truemium OÜ, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
14. Export Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country.
- You are not listed on any U.S. Government list of prohibited or restricted parties.
You agree to comply with all applicable export laws and regulations in connection with your use of the Licensed Application.
15. Apple as Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
This Section 15 applies to the iOS version of the Licensed Application distributed through the Apple App Store. It does not apply to the Android version distributed through Google Play.
16. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Truemium OÜ if you fail to comply with any of its terms. Upon termination of this EULA, you must cease all use of the Licensed Application and delete all copies from your devices.
Truemium OÜ may also terminate or suspend your access to the Licensed Application at any time for violation of the Faly Terms of Service. Upon termination, any unspent Gold credits are forfeited and are not refundable, except as provided in the Faly Terms of Service §7 and §8.
17. Governing Law
This EULA is governed by Estonian law and, where applicable, EU law.
Consumer protection carve-out: Nothing in this EULA deprives you of the protection afforded by the mandatory consumer protection laws of your country of habitual residence. Consumers in Türkiye retain all rights under Turkish consumer-protection law and may bring claims before Turkish courts or consumer arbitration committees. Consumers in the EU/EEA retain all rights under their applicable local mandatory consumer-protection laws. No clause in this EULA imposes a forced exclusive foreign jurisdiction on consumers in Türkiye or the EU/EEA.
